Not sure why init breaks the test. Doesn't happen "for real". refs #505

fixes #419 . we've been using this internally for quite some time.
i'm using the exact solution from @chriskuehl here #419 (comment) and would love to let chris have the contribution if he'd like, but it's been quite a few months now so am putting this up myself
