The Issue
The client has arthritis which causes poor mobility especially because of the effects on her knees. She is 30 years old.
She returned to work after knee surgery and her manager made lewd comments about her personal life stating that she should hang on to her partner because she would not get anyone else. He called her a “cripple” which she found offensive and stated that there are younger and prettier girls waiting to take her place.
She was clearly upset by these comments and asked the EASS for advice.
EASS Advice and Support:
The client was advised by the EASS on the definition of disability and also harassment which included advice on disability harassment, sexual harassment and harassment because of her age. Based on this information and on the advice of the EASS she submitted a grievance to her Managing Director.
An informal meeting was held with a former MD who acted as an impartial listener and her concerns were then considered at board level.
The client has received a decision letter upholding her grievance. The letter offers her an apology for the way that she had been treated and promises that all staff will be given training about appropriate communication and behaviour. Her line manager is to receive more specific training in equality issues.
Due to the advice and support of the EASS, the client has been able to bring the matter to an amicable conclusion. This has avoided formal action in an Employment Tribunal
